Tucker v. Walgreen Co., Case No. 05-cv-440-GPM (S.D. Ill.) is a nationwide race discrimination class action brought by African American employees in retail store and pharmacy management positions at Walgreens.  Goldstein, Demchak, Baller, Borgen & Dardarian's co-counsel in the case are Tiffany Klosener and Amy Coopman of Foland, Wickens, Eisfelder, Roper & Hofer PC of Kansas City, Missouri and Kent Spriggs of Tallahassee, Florida.  Plaintiffs alleged that Walgreens' employment practices resulted in discrimination in promotions of African Americans and assignment of African Americans to less desirable stores for longer periods of time than similarly situated whites.

In March 2007, the EEOC filed a lawsuit alleging similar violations against Walgreens.  The EEOC's case was consolidated with the private plaintiffs' action.   In July 2007, the parties reached a comprehensive settlement that provided for payment of approximately $20 million to the class, extensive injunctive relief to be implemented by Walgreens over a five year period, payments to the class representatives and for attorneys' fees and costs.  On March 24, 2008, the district court gave final approval to the Consent Decree.  GDBBD and the EEOC are currently monitoring Walgreens’ implementation of the Consent Decree.
