With co-counsel Hinton Alfert & Sumner, the firm represents a class of Territory Managers employed by U.S. Foodservice, Inc. in their claim for unreimbursed business expenses.  The case, Burdick v. U.S. Foodservice, Inc., was filed in Alameda County Superior Court on February 5, 2009 and has been assigned to the Complex Litigation department.  Territory Managers are outside salespersons who incur substantial expenses for use of their private automobiles, cell phones, and other items of personal expense, but their employer forces them to bear these work expenses in violation of California law.   In this case we recovered, through a settlement preliminarily approved by the court on January 21, 2010, a total of $14,500,000 for a class of 769 Territory Managers.  The court-ordered notice to class members was mailed on March 2, 2010.  The settlement is subject to final approval of the court at a hearing scheduled for May 26, 2010.
