Bank of America
Contreras, et al. v. Bank of America National Association, filed in San Francisco Superior Court, is a putative class action filed on behalf of current and former mortgage loan officers. The plaintiffs allege that Bank of America has violated California state laws by failing to reimburse mortgage loan officers for business expenses, including cell phone usage and mileage, and by making unlawful deductions from mortgage loan officer wages. On February 10, 2010, the court preliminarily approved a class action settlement that includes this case and five other related cases subsequently filed throughout California.
The settlement is worth up to $16.5 million and benefits over 3,000 California employees. Individualized notice and claim forms were mailed to class members on May 14, 2010.
Claims deadline is July 13, 2010. A final approval hearing is scheduled for September 3, 2010.
