H&R Block Mortgage Corporation
The firm represents a class of approximately 700 Loan Officers formerly employed by H&R Block Mortgage Corporation and Option One Mortgage Corporation in claim for overtime pay and pay for missed meal breaks. The case, filed in March 2007 in the U.S. District Court in Santa Ana, California, is brought as a collective action under the Fair Labor Standards Act (FLSA) and a class action to enforce wage rights under the California Labor Code. In January 2008 the Court certified the case as an FLSA collective action and sent notice to class members of their right to opt in as plaintiffs, and 171 individuals have joined the suit as opt-in plaintiffs. Both plaintiffs and class members worked substantial amounts of overtime "off the clock" but were not paid for their hours, and frequently missed meal breaks due to the Company's pressure to continue working throughout their work periods. Motions to certify the class action and decertify the collective action have been filed and are scheduled for hearing by the court on June 1, 2009.
