Young's Market
On April 14, 2011, the firm, along with co-counsel HammondLaw, PC, filed a class action complaint against Young's Market in Orange County Superior Court, claiming that Young's failed to fully reimburse its outside sales representatives for business expenses necessary for their job, including automobile expenses or mileage and cellular telephone expenses. Our clients who serve as named plaintiffs and class representatives in the case are Christopher Moy, Michael Miller, and Michelle Myers. All of them worked at Young's as Sales Representatives within the past several years. The class they and we represent includes all Sales Representatives who worked at Young's in California at any time in the four years before the case was filed. The case is very similar to another class action case against
Southern Wine and Spirits of America that the firm has been litigating in federal court in San Francisco since August 2010. Young's and Southern Wine bargain jointly with Teamsters Unions that represent Sales Representatives employed by both companies, so with the help of information our firm has obtained in the Southern Wine case we expect the Young's Market case to move forward rapidly.
On May 26, 2011, Young's removed the case to federal court in Santa Ana, California. The firm will file a motion to remand the case to state court before the end of June 2011.
